Should Legal Ambiguity Stop Medial Marijuana Patients from Using?

By now it’s safe to say that the medical marijuana legal confusion is far from over. There have been only a few court cases setting precedents for the treatment, and even these seem to depend on the case and the judge. Oftentimes medical marijuana patients are finding that the law does not protect their rights in other areas of life. The biggest example is the Michigan court ruling that the law does not protect patients from existing business policies. It seems as though the infancy of the law is making it difficult for patients to receive their treatment without the threat of other legal or social repercussions.

A topic that has always been the subject of debate, there was a time where someone could get ten years in jail for possession of two joints. Sometimes it’s difficult to remember that this was less than 50 years ago. There’s no doubt that marijuana is becoming more widely accepted and that it has been proven to yield positive medicinal effects. Despite the progress being made, there are still many areas where the drug is stigmatized, and this is affecting people’s ability to use it legally. Think about the last time someone was fired from their job by using their prescription drugs, most can’t remember the last time they’ve even heard of something like that. Yet, many patients are finding themselves unable to take their medicine without facing legal or social scrutiny.

Risk Benefit Ratio

It seems that the confusion within the medical marijuana law has made it incredibly risky for some to medicate. Is losing your job worth treating your chronic pain? Some would argue that no, it actually isn’t. It seems as though even those who can use marijuana legally still have to hide it just the same as if it weren’t legal. The certification card gives you protection from the police to a certain degree, but is that all it’s actually good for? The substance is still illegal on a federal level which adds to the paranoia of many individuals who are allowed to use it legally.

Unfortunately, there doesn’t seem to be an end in sight for patients who wish to legally use the substance to treat various ailments. Overwhelming medical studies have been conducted to outline the healing properties of marijuana, but its tumultuous past of illegality seems to trump any proven benefits for people to use it. For now it seems that people will need to continue to legally obtain it and deal with any consequences that may arise.

The unwillingness of the Michigan and other state governments to address the issue only makes it more difficult to defend those who are using marijuana to treat pain. So for now, people will just have to hope they don’t lose their job or have their grow stations raided by the feds. It’s pretty amazing how something that was voted legal by the people can carry so many negative consequences.
